Recommendation: To sell the old 3M Security Gates at the annual City auction this summer instead of sending them forward for bid.
Background: It was recently brought to our attention that the Library Board does not have the authority to declare items as surplus and consequently sell them. According to a memo from the City Attorney’s office the City Council has sole authority to do so.
In the March Board meeting, the question was raised as to whether or not the City Attorney’s office reviewed Library statutes and well as City statutes. According to the memo from the City Attorney’s office the Library statutes were reviewed and the City Council still has sole authority to declare items as surplus.
In review of this information, it appears that the most cost effective solution would be to not send the gates forward for bid. Additionally, this would also be the best use of resources.
